These Website & Member Terms of Use (“Terms”) govern your access to and use of websites, member accounts, member portals, and related online services operated by Vosters LLC d/b/a Matinee Social Club (“Matinee,” “we,” “us,” or “our”), collectively, the “Services.”
By creating an account or using the Services, you agree to these Terms.
1. ELIGIBILITY
You must be at least 18 years old to create a Matinee member account or use member-only Services.
Matinee events may be subject to separate age requirements, including a 21+ requirement. Creating a member account does not establish eligibility to attend any particular event.
2. MEMBER ACCOUNTS
You may be required to create or authenticate an account to access certain features.
You agree to provide accurate information and to keep information associated with your account reasonably current.
You are responsible for maintaining the security of your account and for activity occurring through your account.
You may not access or attempt to access another person's account or impersonate another person.

3. TICKET AND EVENT INFORMATION ASSOCIATED WITH YOUR ACCOUNT
Matinee may associate eligible ticket purchases, event registrations, attendance information, and other interactions with your member account using information such as your verified email address.
Information displayed through your account may be obtained from Matinee's records or third-party ticketing platforms.
We do not guarantee that your account will display every historical purchase, event, transaction, or interaction, or that information received from third-party platforms will always be complete, current, or error-free.

4. EVENT TICKETS AND ATTENDANCE
Use of the member Services does not guarantee ticket availability, admission to an event, or eligibility to attend an event.
Ticket purchases, RSVPs, event attendance, refunds, admission, conduct, and other event-related matters are governed by our Terms of Entry and any additional terms presented by the applicable ticketing platform or venue.
If these Terms conflict with the Terms of Entry regarding an event or ticket purchase, the Terms of Entry control with respect to that event or purchase.
5. COMMUNICATIONS
We may use contact information associated with your account to provide service-related communications concerning your account, transactions, tickets, events, security, or use of the Services.
Marketing email and SMS communications are subject to your applicable communication preferences and, where applicable, our Mobile Terms of Service.
6. PRIVACY
Our collection and use of personal information in connection with the Services is described in our Privacy Policy.
By using the Services, you acknowledge that you have received and had an opportunity to review our Privacy Policy.
7. ACCEPTABLE USE
You may not:
Access or attempt to access another person's account or information;
Attempt to bypass authentication, authorization, security, or access controls;
Scrape, harvest, or systematically collect information from the Services without authorization;
Interfere with or disrupt the Services or their infrastructure;
Introduce malware, malicious code, or harmful material;
Use automated systems to abuse or overload the Services;
Attempt to reverse engineer portions of the Services except where applicable law expressly permits it;
Use the Services for fraudulent, unlawful, abusive, or unauthorized purposes; or
Use information obtained through the Services in violation of another person's rights.
8. MATINEE CONTENT AND INTELLECTUAL PROPERTY
The Services and their content, design, branding, graphics, software, text, photographs, videos, logos, and other materials are owned by Matinee or its licensors and are protected by applicable intellectual-property laws.
Except as expressly permitted by us, you may not reproduce, distribute, modify, create derivative works from, publicly display, sell, license, or commercially exploit Matinee's Services or content.
Matinee grants you a limited, revocable, non-exclusive, non-transferable right to use the Services for your personal use in accordance with these Terms.
9. FEEDBACK
If you voluntarily provide ideas, suggestions, or feedback regarding the Services, you permit Matinee to use that feedback without restriction or compensation to you, provided that doing so does not grant us ownership of personal information otherwise governed by our Privacy Policy.
10. THIRD-PARTY SERVICES
The Services may contain integrations with or links to third-party services, including ticketing platforms, authentication providers, payment providers, and social networks.
Third-party services are governed by their own terms and policies. Matinee is not responsible for third-party services that we do not control.
11. CHANGES AND AVAILABILITY
We may add, modify, suspend, or discontinue features or portions of the Services from time to time.
We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.
12. ACCOUNT SUSPENSION OR TERMINATION
We may restrict, suspend, or terminate access to the Services where we reasonably believe an account is being used fraudulently, unlawfully, abusively, in violation of these Terms, or in a manner that threatens the security or operation of the Services or other users.
You may request deletion of your account by contacting help@matinee.club.
Deletion of an account does not necessarily require deletion of transaction, attendance, security, legal, opt-out, or other records that Matinee is permitted or required to retain, as further described in our Privacy Policy.
13. DISCLAIMERS
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
MATINEE DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.
We do not guarantee that account information, ticket history, recommendations, availability, analytics, or information received from third-party services will always be complete, current, accurate, or error-free.
Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.
14. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, VOSTERS LLC, MATINEE SOCIAL CLUB, AND THEIR OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
15. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Vosters LLC d/b/a Matinee Social Club and its officers, employees, contractors, and affiliates from third-party claims arising from your unlawful use of the Services, violation of these Terms, or infringement of another person's rights.
16. CHANGES TO THESE TERMS
We may update these Terms from time to time.
When we make changes, we will update the “Last Updated” date. Where appropriate, we may provide additional notice of material changes.
Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
17. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles.
To the extent permitted by applicable law, disputes arising from these Terms or the Services shall be brought in the state or federal courts located in New York County, New York.
18. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
19. ENTIRE AGREEMENT
These Terms, together with any additional terms expressly applicable to a particular Service, constitute the agreement between you and Matinee regarding your use of the website and member Services.
These Terms do not replace our Terms of Entry, which separately govern ticket purchases and attendance at Matinee events.
